GENERAL CONDITIONS OF SALE

 General:

These general conditions apply to any agreement entered into by LensOnline. These conditions will prevail to any written or printed conditions of the buyer. By making an order, the buyer accepts the present conditions. Any additions or alterations to these general conditions are only valid after prior written approval of LensOnline.

Order:

Orders are made online at the website - www.lensonline.be -, by e-mail or by telephone. The buyer receives confirmation of the order by e-mail. Special offers given on the website are free of engagement. They only become binding after confirmation of the order on the website and upon receipt of the confirmation of lensOnline by e-mail.

Delivery:

LensOnline charges 3.50 euros for deliveries within the Benelux. Shipping costs outside the Benelux will be charged at 6.00 euros. For shipment of contact lens cleaning products outside of Belgium, there is a surcharge of 20 euros in addition to normal postage. LensOnline only delivers after receipt of payment. Most items are available in stock. The time of delivery listed on the website is indicative and not binding. In case of delay in delivery the buyer is not entitles to claim damages or to ask for the dissolution of the contract. The buyer has no right to postpone any of its obligations from the purchase at LensOnline. In case of force majeure , LensOnline is entitled to cancel the agreement without judicial intervention, or to postpone the time of delivery until there is no longer a force majeur situation, without the buyer having the right to claim for damages. In case of non-compliance with the terms of the agreement by the buyer Lensonline is entitled to suspend any delivery or service. The invoice is enclosed with the order.

Prices:

The prices of the LensOnline products are listed on the website and are guaranteed by LensOnline, subject to force majeure. Prices are listed in euros and 21% VAT inclusive. The shipping costs are not included. Check Article 3 for more information.

Payment:

Payments are made via Internet, by wire transfer or in cash in one of our branches. Payments over the Internet are protected though a secured server. In case of wire transfer LensOnline does not deliver the order until receipt of payment. Check www.ogone.be for more information concerning payments. The buyer is not entitled to deduct amounts for claims issued against Lensonline. Price reductions are only valid if expressly indicated on the website.

Complaints :

Any complaint about non-compliance of the delivered goods or visual defect must immediately be communicated in writing at the time of delivery, in default of which, each complaint will be considered null and void. Any complaint about a hidden non-compliance of the delivered goods or hidden defect must be communicated in writing within a term of 14 days after its discovery, in default of which, such complaint will be considered null and void. By issuing a complaint, the buyer is not released of its payment obligations. A returned shipment must remain free of charge for LensOnline and will only be accepted if LensOnline has previously given written permission.

Liability and warranty:

LensOnline delivers the products according to data provided by the buyer. LensOnline assumes that the buyer regularly, preferably every 6 months, passes an eye inspection with an ophthalmologist or contact lens specialist. This is expressly confirmed by the buyer upon accepting these general conditions . The quality and effectiveness of products are indicated on the EC product info of the manufacturer. LensOnline products are delivered in the manufacturer's original packaging. The buyer agrees to read the instructions and conditions of use prior to the use of products. In case of doubt, the buyer shall contact the manufacturer before using the products. LensOnline is not responsible for any technical shortcomings in the packaged products or possible mistakes in the general conditions of the manufacturer. LensOnline can not take responsibility for the tolerance of products and their possible consequences for the eyes. Neither is LensOnline liable if the defect is due to negligence of maintenance, intentional degradation or negligent application of instructions and requirements of the manufacturer, inattention of negligence.

Personal Data:

Any personal information that the buyer communicates to LensOnline within the scope of the order, is kept in a customer filing system. LensOnline uses this information for commercial purposes, to submit information to the buyer and for order processing purposes . The buyer may at any time consult this information , or ask for adaptation or elimination. Personal information will never be disclosed to third parties.

Terms:

In accordance with the law of fair trade practices, the buyer is entitled to renounce to the sale without any penalty and without having to motivate its decision within a term of 14 days upon receipt of the goods. The buyer will inform LensOnline about its intention to return the goods and will do so within the three days following strictly the shipment instructions provided by Lensonline. Repayment will be effectuated within two week after receipt of the goods if the goods are received within the term and sufficiently stamped. No claim will be accepted if the delivered goods have been used, if the original packaging has been opened of when the goods are not returned in the original packaging. This article does not apply for personal goods , f.e. toric Lenses or personal lenses specially manufactured for the buyer.

Applicable law:

These general conditions and the contract are subject to Belgian law. The court of the district where the supplier or the headquarters of the company is based has exclusive jurisdiction.
